JUSTICE PURNENDU SINGH ORAL ORDER 03-11-2025 In spite of repeated calls no one appears on behalf of the petitioner, however, Mr. Ajit Kumar, learned APP for the State has tendered his appearance on behalf of the State.
2. The petitioner has chosen not to appear before this Court after obtaining interim protection, which requires order to be passed on merits.
3. The order taking cognizance dated 17.02.2016 has been passed by the learned Chief Judicial Magistrate, Rohtas at Sasaram by which he has taken cognizance against the petitioner for the offences under Sections 353, 277, 427, 504 and 506 of Indian Penal Code arising out of Sasaram(T) P.S. Case No.464 of 2013. The FIR is of the year 2013 and
Patna High Court CR. MISC. No.63740 of 2019(3) dt.03-11-2025 2/2 application under Section 482 of Cr.P.C. was filed in the year 2019. Information regarding the stage of trial since 2013 till date is not on record. Vide order dated 29.04.2025 this Court stayed the proceeding pending before the learned District Court in connection with Sasaram(T) P.S. Case No.464 of 2013. In such circumstances, I find that no purpose will be served by keeping the present application pending before this Court. The order dated 29.04.2025 is recalled.
4. The learned District Court is directed to proceed with the trial.
5. Accordingly, the present application stands disposed of.
