JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-07-2017 Heard learned Senior Counsel for the petitioner and learned Senior Counsel appearing on behalf of the Vigilance Department.

This application, for grant of anticipatory bail, arises out of Karpi Town Police Station Case No. 19 of 2017, disclosing offences under Sections 420/419/467/468/ 471/472/34 of the Indian Penal Code.

The allegation against the petitioner is of having used forged mark sheet of Teachers' Eligibility Test to secure her appointment as Panchayat Teacher.

Patna High Court Cr.Misc. No.25858 of 2017 (2) dt.11-07-2017 2/3 Learned Senior Counsel appearing on behalf of the petitioner has submitted that the petitioner relied on the document, which was supplied by the Board, while applying for her appointment as Panchayat Teacher. He has further submitted that since the petitioner is a lady and there is no likelihood of her fleeing from the course of investigation of trial, no purpose would be served if she is taken into custody. He submitted that the petitioner is ready to co-operate with the police during investigation. Considering the above submission, this application is allowed.

Let the petitioner, Smt. Madhuri Kumari, in the event of her arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, at Jehanabad, in connection with Karpi Police Station Case No. 19 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two
