JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 484C of 2017, disclosing offence under Section 498A of the Indian Penal Code. Prosecution case as per complaint petition is of torturing mentally and physically to the informant with respect to demand of motorcycle and cash of Rs.4,00,000/-. Submission of the learned counsel for the petitioner is that he is still ready to keep her with dignity and care and furthermore, there is no specific allegation attributed against the petitioner. Further submission is that the complainant/informant has appeared before the learned Sessions Judge and she refused to reside with the petitioner on the ground that he had remarried

Having heard both sides, as there is no chance of tampering with the evidence, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Kishanganj, in connection with Complaint Case No. 484C of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
