1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 36 of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent.

4. Allegation is of recovery of 300 litres of liquor from a sack allegedly thrown by the accused persons and the petitioner was apprehended at the spot along with the sack from which liquor was recovered.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. It is further submitted that the real culprits fled away from the place of occurrence and since petitioner was passing by the same area

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Darauli P.S. Case No. 185 of 2024.
