Petitioner prays for grant of anticipatory bail in Khagaria P.S. Case No. 301 of 2013 registered under Sections 420, 468 and 471 of the Indian Penal Code.
The Executive Engineer lodged the case in the year 2013 alleging that on the basis of forge/fake transfer order, the petitioner worked in the Office as Peon. Counsel for the petitioner submits that the Service Record is with the authority. The inquiry is yet to be made into the illegal appointment of the petitioner as alleged.
Counsel for the State, on the other hand, submits that in course of investigation, witnesses have supported that the petitioner worked as Peon on the basis of forged document. In my view, it is not a fit case for grant of anticipatory
