The petitioner apprehends his arrest in Garkha P.S. Case No. 389/2018, registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code and sections 30, 30(A), 38 and 41 of Bihar Prohibition & Excise Act.

The police intercepted a truck and a Sumo vehicle from which 3258 litres of Indian made foreign liquour was recovered. Mahangu Rai and Rajesh Sah were apprehended and Mahangu Rai disclosed the name of petitioner. Similarly situated co-accused Munna Prasad whose name also figured in the case on the disclosure of the co-accused, has already been granted anticipatory bail vide order dated 12.12.2018 passed in Cr. Misc. No. 66367/2018.

No.80004 of 2018(2) dt.11-01-2019 2/2 Having considered the fact that nothing has been recovered from possession of the petitioner and the name of petitioner figured in the case on the basis of confession of apprehended accused, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District & Sessions Judge, Saran, Chapra in connection with Garkha P.S. Case No. 389/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
