Commanding the respondents not to construct police station building in the 5 acres portion of plot no. 1977 under khata 275, village-Barem, P.S.

Nabinagar, DistrictAurangabad donated by the owner of the land for establishment of school in which a High School is also running;

II. Commanding the respondents to stop any ongoing work in the aforesaid land for construction of

Patna High Court CWJC No.13672 of 2023(3) dt.01-11-2023 2/2 police station and to remove any structures made for the purpose from the aforesaid land;

III. Commanding the respondents not to interfere in the peaceful possession, use and occupation of the aforesaid land by the school."

At the outset, the learned counsel for the respondent-State seeks to file a counter affidavit which is taken on record.

At this juncture, the learned counsel for the petitioner, on going through the averments made in the counter affidavit filed in the present case, seeks liberty on behalf of the petitioner to avail such other alternative remedy as are otherwise available under the law including that of filing a suit before the Ld. Civil Court having competent jurisdiction, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off as not pressed.
