JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-08-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences under Section 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant but it is the informant who deserted the petitioner and took away all her belongings in presence of her father. Hence, petitioner, at present is not in a position to keep the informant.

It is submitted by learned counsel for the informant that informant denies the factum of desertion as the informant is ready to resume the conjugal life and she had

In view of the facts discussed above, there is no chance of the issue being resolved at present. In the circumstance, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barauli P.S. Case No. 241 of 2013, pending in the Court of learned Chief Judicial Magistrate, Gopalganj. With the observations above, the application stands disposed of.
