The petitioner apprehends arrest in a case registered for the offence punishable under sections 406/420 of the Indian Penal Code and section 138 of the NI Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He is even not named in the FIR. Petitioner is merely project manager of the company and dishonoured cheques were not issued by him as such no case under the NI Act is made out against him. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 62430/2022.
Patna High Court CR. MISC. No.62594 of 2022(2) dt.16-03-2023 2/2 Learned counsel appearing for the State as well as the informant oppose the prayer for bail.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati Gaya in Sherghati Police Station Case No. 383 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
