By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the first information report in connection with Saharsa Sadar P.S. Case No.166 of 2015 registered under Sections 366A and 363 read with 34 of the Indian Panel Code. At the outset, it has been contended by the learned counsel for the petitioner that during pendency of the application, the police have already submitted final report holding the case to be a mistake of fact under Section 173(2) of the Code of Criminal
Patna High Court Cr. WJC No.311 of 2015 (2) dt.25-01-2016 2/2 Procedure in the court of Magistrate.
In that view of the matter, learned counsel for the petitioner seeks leave to withdraw the present application as the grievance of the petitioner has already been redressed. Accordingly, the application is dismissed as withdrawn.
