The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379/34 of the Indian Penal Code.

The basic accusation is of committing theft of battery of a tractor. It is alleged that the petitioner went to sale the said battery to one Md. Jalal.

It is submitted by learned counsel for the petitioner that the battery was not recovered from the possession of the petitioner although it was recovered from the possession of one Md. Jawed.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.15852 of 2015 (2) dt.16-04-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with K. Nagar P.S. Case No.638 of 2014, pending before the learned Judicial Magistrate, 1st Class, Purnea.

With the above observation, this application is, accordingly, disposed off.
