The petitioners apprehend their arrest in Saharsa Sadar P.S. Case No. 828 of 2014, registered for the offences punishable under Sections 384, 307 and other Sections of the Indian Penal Code.
The informant made allegation against the petitioners that they all assaulted him and asked him either to sale his land or pay extortion. The petitioners assaulted the informant and also snatched Rs. 7100/- from his pocket.
Learned counsel for the petitioners submits that there is a land dispute.
Patna High Court Cr.Misc. No.16603 of 2015 (2) dt.05-05-2015 2/2 But from the perusal of the FIR, there appears no land dispute between the informant and the petitioner. It appears that the petitioners assaulted the informant and snatched his money and demanded extortion.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
