This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Sakari PS Case No. 131 of 2018 for the alleged offence under Sections 272, 273, 406, 420 and 34 of the Indian Penal Code and Sections 30(a), 36, 38(i) and 41(i) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 04.09.2018 for the alleged recovery of 225 liters of Nepali wine. Considering the fact that the petitioner has no criminal antecedent and the fact that he has been in custody since 04.09.2018, this application is allowed. Let the petitioner, above
