Petitioners apprehend their arrest in connection with Kishanganj P.S. Case No.327 of 2019 for the offence punishable under Sections 420, 379, 363, 511, 341/34 of the Indian Penal Code.

The allegation against the petitioners as per the First Information Report is that petitioner No.1 along with petitioner No.4 tried to commit kidnapping of informant's minor daughter by enticing her to provide a job in Saudi Arab and for that purpose, they received a sum of Rs.6,000/- from the minor

Patna High Court CR. MISC. No.59487 of 2019(2) dt.19-09-2019 2/3 daughter of the informant as well as a sum of Rs.6,000/- was also taken from the friend of informant's daughter. It has further been alleged that while the informant caught hold, the petitioner No.1 and 4 and was taking them to the police station along with motorcycle belonging to petitioner No.1, they were forcibly freed by petitioner No.2 and 3.

Learned counsel for the petitioners submits that from perusal of the First Information Report, it would be apparent that the petitioners have been implicated in a concocted story inasmuch as the allegation is that a sum of 12,000/- was taken from the daughter of the informant as well as her friend. Learned counsel further submits that prior to the present FIR one case bearing Kishanganj P.S. Case No.322 of 2019 was lodged by petitioner No.4 against the relative of the informant. Having regard to the submissions made by the parties and taking into consideration the fact that daughter of the informant was not kidnapped by the petitioner, as such, I am inclined to grant anticipatory bail to all these petitioners. Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon

Patna High Court CR. MISC. No.59487 of 2019(2) dt.19-09-2019 3/3 furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
