2. The petitioner is in custody in connection with Sessions Trial No. 402 of 2024 arising out of Lachhuar P.S Case No. 97 of 2023 registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that earlier the bail application of the petitioner was rejected vide order dated 22.11.2024 in Cr. Misc. No. 39648 of 2025. HE further submits that petitioner is not named in the FIR and his name has been surfaced from the confessional statement of coaccused Laxmi Kumari who has already been granted bail vide

Patna High Court CR. MISC. No.60449 of 2025(2) dt.12-09-2025 2/3 order dated 22.11.2024 i.e. on same day. He further submits that the main assailant of this case namely Sonu Kumar has also been granted bail by this Court in Cr. Misc. No. 26648 of 2025 and other co-accused namely Chhotu Kumar @ Namdev who has been identified by the deceased has also been granted bail Vide Cr. Misc. No. 3107 of 2024. He further submits that the petitioner is in custody since 03.01.2024 having only one criminal antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and the materials available on records, it appears that all co-accused persons have been granted bail by the various coordinate Bench of this Court i.e. main assailant of this case namely Sonu Kumar has also been granted bail by this Court in Cr. Misc. No. 26648 of 2025 and other co-accused namely Chhotu Kumar @ Namdev who has been identified by the deceased has also been granted bail Vide Cr. Misc. No. 3107 of 2024. So, considering the materials available on record, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VI, Jamui in
