The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307,353,337 and 427 of the Indian Penal Code and section 47(a) of Excise Act.
The prosecution case is that the informant being a police officer, during patrolling, received secret information that one Naxal Karu Mandal has taken shelter in the nearby village Dharhara then the informant proceeded to raid the place, in the meantime he received information about the sale of illicit liquor then he raided the house of Raghunath Sao and recovered huge quantity of country made liquor but at the house of Raghunath
Patna High Court Cr.Misc. No.3039 of 2016 (2) dt.19-01-2016 2/2 Sao a mob of 40 people pelted stones and confined the informant and caused injury to the police personnels.
It is submitted by the learned counsel for the petitioner that the accusation is against the mob. Co accused Dhanram Kumar and the son of Raghunath Sao at whose house illicit liquor was recovered have been granted anticipatory bail vide Cr. Misc. Nos. 46534 and 37030 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Barachatti P.S. Case No.218 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
