The petitioner seeks regular bail in connection with Aurangabad (Muffasil) PS case no. 171 of 2019 instituted for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.

The allegation is regarding recovery of 10 ltrs. of illicit liquor from the motorcycle of the petitioner although various quantities of liquor was recovered from other vehicles and other co-accused persons have also been arrested by the police.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is an accused in one other

Patna High Court CR. MISC. No.57779 of 2019(2) dt.01-10-2019 2/2 case but he is on bail in the said case. The petitioner is said to be languishing in custody since 27.07.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII-cumSpecial Judge (Excise), Aurangabad (Bihar) in connection with Aurangabad (Mufassil) PS case no. 171 of 2019.
