Petitioner seeks bail in Cheriya Bariyarpur P.S. Case No.214 of 2018 instituted for the offence under Section(s) 290 Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged that 133 litres foreign liquor has been recovered from the orchard of Mirtunjay Singh @ Sardar. There is no recovery from conscious possession of the petitioner as per seizure list.
Counsel for the petitioner submits that Petitioner is in custody since 22.11.2018 having no criminal antecedents. In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.79819 of 2018(2) dt.11-01-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise, Act, Begusarai, in connection with Cheriya Bariyarpur P.S. Case No.214 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
