This is the third attempt of the petitioner to approach before this Court for bail. Earlier, the prayer for bail of the petitioner was rejected with a direction to the learned Court below to expedite the trial.
Vide order dated 23.11.2022, a report was called for from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 02.12.2022 has been sent by the learned Additional District & Sessions Judge-XI, Kaimur at Bhabua. In his report, the learned Judge has, inter alia, stated that the out of 14 charge-sheet witnesses, 10 witnesses have
Patna High Court CR. MISC. No.60718 of 2022(3) dt.04-01-2023 2/2 been examined and rest are left to be examined. . Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected.
However, the learned court below is directed to conclude the trial as expeditiously as possible preferably within a period of six months.
The Superintendent of Police, Bhabua is directed to produce the witnesses in the court on each and every date fix in this case, failing which this Court may take serious view in this matter.
Let a copy of this order be communicated to the Superintendent of Police, Bhabhua.
