The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 273 of the Indian Penal Code and 47(a) of the Excise Act. From the grocery shop of the petitioner 19200 ml. country liquor was recovered.
It is submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent and the FIR has been transmitted to the learned court below with inordinate delay.
Considering the quantity of recovery, it is a case for consideration of prayer for regular bail, if the
Patna High Court Cr.Misc. No.3026 of 2016 (2) dt.22-01-2016 2/2 petitioner surrenders before the learned court below within a period of six weeks from today in connection with Shankarpur P.S. Case No. 105 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Madhepura. With the aforesaid observation, this application is disposed of.
