JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-394 of the Indian Penal Code.
Petitioner is not named but earlier prayer for bail of the petitioner was rejected by this court, taking note of this fact that stolen motorcycle and other articles were recovered from his possession.
Submission on behalf of petitioner is that the seizure list of the present case goes to show that recovery of motorcycle and other articles was made from joint possession of petitioner and one co-accused Suman Kumar but the aforesaid co-accused, Suman Kumar has already been granted privilege of bail by a
Patna High Court Cr.Misc. No.4980 of 2016 (3) dt.11-05-2016 2/2 coordinate bench of this court vide order dated 15-12-2015 passed in Cr. Misc. No. 52413 of 2015 whereas; Petitioner is languishing in jail custody since 21-07-2015 and there is no possibility of conclusion of trial of the petitioner in near future. Considering the above-said submissions as well as the period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiapur P.S. Case No. 620 of 2015 to the satisfaction of Sri Sunil Kumar Tripathi, learned Judicial Magistrate-Ist Class, Muzaffarpur.
