JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 This application has been filed for modification of order dated 26.04.2019 passed in Criminal Miscellaneous No.10700 of 2019, by which the petitioner and other accused persons have been granted the privilege of anticipatory bail with direction to surrender within a period of six weeks in connection with Complaint Case No.228 of 2017.

Submission of learned counsel for the petitioner is that other two accused persons have already surrendered but the petitioner has not surrendered due to some unavoidable circumstances.

Heard learned A.P.P. also.

No.57114 of 2019(2) dt.11-09-2019 2/2 Having heard both sides and considering the facts as stated above, I am not inclined to interfere with the earlier order passed by this Court. However, petitioner may surrender and pray for regular bail and the same shall be considered by the learned court below considering the fact that he was granted anticipatory bail earlier and prayer for regular bail shall be disposed of on the same day.

This application is accordingly dismissed.
