2. The petitioners apprehend arrest in connection with Bannu Bagicha PS Case No.47 of 2025 dated 21.06.2025, instituted under Sections 127(1), 115(2), 109, 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioners and others is of assaulting the informant. Specific allegation against petitioner no.1 is that he assaulted the informant on his head by means of Danda and against petitioner no.2 is that he assaulted the informant by means of Danda on the back and other parts of the body.

Learned counsel for the petitioners submits that there is specific allegation that the petitioner no.1 assaulted the informant on his head by means of Danda and the petitioner no.2 assaulted on the back and hand of the informant by means of Danda due to which the informant received simple injuries. Injury report of the informant is annexed as Annexure-2. Lastly, it is submitted that the petitioners have no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Lakhisarai, in Bannu Bagicha PS Case No.47 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
