Mr. Zainul Abedin, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State .

2. The petitioners apprehend bail in a case registered for the offence punishable under Sections 80, 238 and 3 (5) of BNS.

3 . As per F.I.R., informant namely Ruby Kumari alleged that the marriage of her daughter namely, Anjali Kumari was solemnized with co-accused Amarjit Kumar on 20.05.2023 and after some time of marriage , all the accused persons including these petitioners harassed and tortured, daughter of informant

Patna High Court CR. MISC. No.60441 of 2025(2) dt.08-09-2025 2/3 for dowry and due to non-fulfillment of the same , all the accused persons finally committed murder of daughter of informant ( deceased ).

4. It is submitted that petitioner No. 1 is brother-in -law ( bhaisur ) , petitioner No. 2 is mother-in -law , petitioner No. 3 is brother-in -law ( devar ) and petitioner No. 4is sisterin -law ( gotani ) of the deceased. They are simply victims of over implication. They have got no concern with the affairs of the deceased and her husband and are separate in mess and property. Thrust of the accusation is against husband of the deceased who is already in custody . Petitioners claim clean antecedent.

5 . On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case , nature of accusation and clean antecedents of the petitioners, the prayer for grant of pre - arrest bail of to the petitioners is allowed.

7. Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on

No.60441 of 2025(2) dt.08-09-2025 3/3 furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub- Divisional Judicial Magistrate West Muzaffarpur in connection with Kathaiya P.S. Case No. 178 of 2024 , subject to the conditions laid down under sections 482 ( 2 ) of BNSS 2023 .
