The petitioner seeks bail in Nath Nagar P.S. Case No.570 of 2018 registered for the offence punishable under Sections 395 of the Indian Penal Code.

Allegation is that 6-7 accused persons having arms were engaged in robbery. It is alleged that accused persons came near Scorpio of the informant and snatched a mobile and, thereafter, they tried to flee away but one of the co-accused, namely, Ajay Kumar was caught hold by the informant with the help of others, however others managed to flee away and apprehended accused Ajay Kumar disclosed the name of other co-accused including the petitioner.

Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case only

Patna High Court CR. MISC. No.72070 of 2019(3) dt.17-02-2020 2/2 on the basis of confessional statement of co-accused Ajay Kumar and except the confessional statement, there is no other incriminating material against the petitioner. Nothing has been recovered from the possession of the petitioner. The petitioner is accused in one more case and he is in custody since 10.06.2019. Further submission is that no T.I.Parade has been made. In this case chargesheet has been submitted Heard learned Addl. Public Prosecutor.

Considering the facts and circumstances of the case as well as the fact that co-accused has been granted bail by a coordinate Bench of this Court vide order dated 22.02.2019 passed in Cr.Misc.No.78563 of 2018, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in connection with Nathnagar P.S.
