This application, for grant of anticipatory bail, arises out of Rajapakar (Baranti O.P.) P.S. Case No. 80 of 2016, disclosing offences under Sections 147, 148, 307, 341, 323, 324, 379, 504 and 506 of the Indian Penal Code.
Patna High Court Cr.Misc. No.27261 of 2017 (2) dt.01-07-2017 2/3 The allegation against the petitioner Nos. 1 and 2 is of assaulting the informant with Farsa on his head and palm respectively. So far as rest of the petitioners are concerned, the allegations against them are general and omnibus. Referring to the Injury Report, learned counsel for the petitioners has submitted that injuries have been found to be simple in nature. He has also submitted that it is apparent from the First Information Report that there is some dispute between the parties over an Orchard.
Considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VII, Vaishali at Hajipur, in connection with Rajapakar (Baranti O.P.) P.S. Case No. 80 of 2016, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on
