ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 08.11.2015 in connection with a case registered for the offences punishable under Sections 366/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the girl is a major and the present case is case of love marriage. He submits that the victim girl has sworn on affidavit filed before the learned Chief Judicial Magistrate, Bhagalpur, stating that the statement made by her under Section 164 Cr. P.C., was made under undue pressure and that things has now been sorted out and she is living peacefully in the family of the petitioner.

Considering the aforementioned facts and circumstances

Patna High Court Cr.Misc. No.3730 of 2016 (2) dt.09-02-2016 P2/2 and that girl in question who was a victim of the folly of the petitioner submitted that things have been set right, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 497 of 2015. It is further made clear that of the two bailors, one of the bailors shall be the father (blood relative of the petitioner) and the second bailor shall be the victim girl Shonam Kumari, now stated to be the wife of the petitioner.
