The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468 and 120B of the Indian Penal Code.
The informant, Chowkidar alleged that one passport application has come for verification and the applicant of the passport was Md. Kasim, Son of Gulab Miyan, Village Harpur Nag, Police Station Mahesi, District-East Champaran and Md. Husnan, Son of Md. Kasim, Village Harpur Nag, Police Station Mahesi, District-East Champaran was the identifier. During the course of investigation, it was found that Md. Kasim is father of Md. Husnan and disclosed that Fakruddin, the petitioner S/O Subham Mian, Resident of village- Rajpur Azad Nagar, P.S.
Patna High Court Cr.Misc. No.18424 of 2015 (4) dt.16-10-2015 2/2 Kesaria, District- East Champaran had taken the form of preparing passport. The applicant would not ascertain.
It is submitted that except the disclosure made by Md. Kasim there is no material against the petitioner to show that the petitioner filed the application for passport of a fake person. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Mahesi P.S. Case No. 216 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
