The petitioner seeks bail in connection with Ratanpura P.S. Case No. 46 of 2018 instituted for the offence under Section(s) 366A/34 of the Indian Penal Code.

In the written report, it is alleged that 17 year old daughter of informant had gone outside the house and she did not return. The informant learnt during search that her daughter used to talk with this petitioner. The informant went to the house of this petitioner but the family members did not give satisfactory reply. The informant has further alleged that this petitioner and one Roshan Paswan used to talk with her daughter on her mobile phone. Learned counsel for petitioner submits that victim, on recovery, has given her statement U/164 Cr.P.C., wherein, she has stated that none has kidnapped her. She herself went with Sonu

Patna High Court Cr.Misc. No.79896 of 2018(2) dt.17-01-2019 2/2 Kumar. The medical report of the victim girl disclosed the age between 18 to 19 years.

Petitioner is in custody since 13.8.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur at Supaul in connection with Ratanpura P.S. Case No. 46 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
