The petitioner is an accused in a case under sections 414 of the Indian Penal Code and Section 25(1-B)A, 26 and 35 of the Arms Act.
The allegation against the petitioner is that one live cartridge was recovered from the possession of the petitioner. It is also alleged that he was found driving truck, which was a stolen one.
It is submitted on behalf of the petitioner that he is driver by profession and he was not aware that the truck was stolen one. It is further submitted that another co accused who was found in possession of fire arm has been granted bail. The
Patna High Court Cr.Misc. No.18327 of 2015 (2) dt.30-06-2015 2/2 petitioner is in custody since 23.12.2014 having no criminal antecedent.
In the facts and circumstances of the case, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in Jamui P.S.Case no. 329/2014. One of the bailors shall be his own/close family member.
