Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 26.06.2020, charge-sheet has been submitted and has antecedent of three cases.
The informant alleges that he was informed that his brother was shot dead in the night while he was sleeping at the terrace.
Learned counsel for the petitioner submits that the FIR was against unknown and name of this petitioner transpired in the confessional statement of co-accused Mukesh Choudhary, who has

No. 15018 of 2018, as such, the petitioner also deserves to be enlarged on bail. Learned counsel very fairly submits that the trial has commenced and one witness has been examined.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 26.06.2020, charge-sheet has been submitted and co-accursed has been granted bail, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Case No. 109 of 2020 arising out of Asarganj P.S. Case No. 76 of 2017, subject to the condition that one of the bailors of the petitioner shall be his father (Mohan Paswan) and further if the learned court below comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner then in that event the learned court below shall forthwith cancel the bail bond of the petitioner by recording reasons.
