JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 The present application has been filed for modification of the order dated 13.05.2013 passed in Cr. Misc. No. 16212 of 2013, whereby the petitioner was granted provisional bail in connection with Mirganj P.S. Case No. 269 of 2012. The provisional bail of the petitioner was to be confirmed by learned Court below on substantial restoration of matrimonial harmony within a period of one year, or if the informant deliberately refuses to reside with the petitioner.

The petitioner took the stand before this Court that he will keep the informant with dignity and honour and on that ground alone the provisional bail of the petitioner was granted. But, contrary to the undertaking given before this Court the petitioner took a stand before learned Court below that he has already divorced the informant and consequently second anticipatory bail application being Cr. Misc. No.

Patna High Court Cr.Misc. No.50269 of 2014 (2) dt.04-02-2015 2/2 03.09.2014. Now again the present modification application has been filed for modification of the order dated 13.05.2013 passed in Cr. Misc. No. 16212 of 2012.

This Court is not inclined to modify the order dated 13.05.2013 passed in Cr. Misc. No. 16212 of 2013. Accordingly the application is dismissed.
