Mr. Mustaque Alam ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Bakhtiyarpur P.S. Case No. 356 of 2018 for the offences punishable under Sections 401, 414 of the Indian Penal Code. The allegation is regarding unknown miscreants having committed theft and subsequently the petitioner is said to have been arrested on account of suspicion by the informant regarding the petitioner having a hand in the alleged theft. Learned counsel for the petitioner submits that no recovery has been made from the conscious possession of the petitioner as well as no TIP has been held. It is further submitted that petitioner is having a clean antecedent and he is languishing

Patna High Court Cr.Misc. No.79551 of 2018(2) dt.24-01-2019 2/2 in custody since 11.07.2018. It is further submitted that similarly situated co-accused person has been granted bail vide order dated 16.01.2019 passed in Cr. Misc. No. 80634 of 2018. Having regard to the fact and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh (Patna) in connection with Bakhtiyarpur P.S. Case No. 356 of 2018.
