The petitioner seeks bail in connection with Sonepur P. S. Case No.107 of 2021, instituted for the offences under Sections 413 and 414 of the Indian Penal Code read with Sections 37(b)(c) and 30(c) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 02.03.2021, charge-sheet has been submitted in the case and has antecedent of five cases and the informant alleges that petitioner was found in a drunken condition and nothing was recovered from him. The learned counsel for the petitioner submits that petitioner has been falsely implicated as neither he was drunk, nor anything was recovered from him and the police implicated
Patna High Court CR. MISC. No.72312 of 2021(2) dt.02-03-2022 2/2 him falsely as he was not ready to palm their grease. The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Sonepur P. S. Case No.107 of 2021.
The application stands allowed.
