JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498(A), 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is of torturing the informant for non fulfillment of demand of additional dowry. On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. It is further submitted that there is no chance of reconciliation between the parties. It is also submitted that the petitioner is ready to deposit an amount of Rs. 2000/- (two thousand) per month in the court below, which may be released in favour of the informant.
On behalf of the State it has been submitted that the
Patna High Court Cr.Misc. No.19027 of 2015 (4) dt.04-09-2015 2/2 petitioner is named in the FIR and he is the husband of the informant.
Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 2000/- (two thousand) per month in the court below, which shall be released in favour of the informant.
Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Motihari, East Champaran in connection with Kotwa P.S.Case No.04 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
