The petitioner is in custody in connection with Session Trial No. 576 of 2018 arising out of Athmal Gola P.S. Case No. 85 of 2018 for the offences under Sections 147, 148, 149, 341, 323, 324, 379, 504, 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedents and he is in custody since 10.05.2018. He further submits that there is omnibus allegation against all accused persons although seven accused persons named in the Fardbeyan. He further submits that similarly circumstanced co-accused Raja Ravidas has been granted bail in Cr. Misc. No. 70008 of 2018 vide order dated 03.12.2018 and

Patna High Court Cr.Misc. No.80613 of 2018(2) dt.16-01-2019 2/2 also considering the fact that only one injury was found on the body of the deceased.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Sessions Judge-III, Barh, DistrictPatna in connection with Sessions Trial No. 576 of 2018 arising out of Athmal Gola P.S. Case No. 85 of 2018.
