2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304B and 34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner along with others has killed Sarita Devi (deceased) by setting her on fire.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the petitioner is sister-in-law of the deceased. From perusal of the FIR, it is clear that there is no specific allegation against this petitioner rather the main thrust

Patna High Court CR. MISC. No.61762 of 2025(2) dt.08-09-2025 2/2 of allegation is against the husband of the deceased who is already in judicial custody. There is no allegation of demand of dowry against this petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 25.05.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Saraiya (Jatipur O.P.) P.S. Case No. 518 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV (west) Muzaffarpur.
