JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in connection with Neemachandpura P.S. Case No. 89 of 2016 for the offences punishable under Sections 30(A) and 30(D) of the Bihar Prohibition and Excise Act, 2016.
It has been alleged that the petitioners were engaged in manufacturing illicit liquor while the police has conducted the raid. On seeing the police the miscreants fled away, out of three one was apprehended by the police. The apprehended person disclosed the names of the petitioners.
Submission of the learned counsel for the petitioners is that there is no direct accusation against the petitioners and
Patna High Court Cr.Misc. No.29552 of 2017 (2) dt.14-07-2017 2/2 nothing has been recovered from their possession. He further submits that the petitioners have no criminal antecedent and have been falsely implicated in this case.
Let, the petitioners, above named, in the event of their arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Neemachandpura P.S. Case No. 89 of 2016 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
