====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

The FIR of the occurrence of murder of the husband of the informant was lodged against unknown. During investigation, the petitioner was suspected for the reason that he is agnate of the deceased.

Submission is that no one claims to have seen the petitioner along with deceased at any point of time prior to his death. Petitioner has got no criminal antecedent. Petitioner is in custody since 24.06.2019.

Considering the facts that only material against the petitioner is suspicion, let the petitioner, above named, be

Patna High Court CR. MISC. No.57626 of 2019(2) dt.19-09-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nawanagar Police Station Case No. 84 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
