The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Allegation is that the accused persons on the gun point committed loot of mobile and cash from the informant and his companion.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. He was passing by when the occurrence had taken place. There is no recovery of stolen money from the possession of the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rohtas in connection with Suryapura P.S. case No.40 of 2019.
