JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-12-2025 The present petition has been filed for restoration of a writ petition bearing CWJC No. 7916 of 2019, which has stood dismissed for default in view of non-compliance of the peremptory order dated 26.06.2019.

The learned counsel for the petitioner submits that on account of illness the counsel could not appear before this Court when the case was called out for hearing, hence the peremptory time granted for removal of defects expired by the

Patna High Court MJC No.3534 of 2019(3) dt.12-12-2025 2/2 time, he came to know about the said order dated 26.06.2019, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC No. 7916 of 2019 to its original file, subject to removal of the defects pointed out by registry, within a period of four weeks from today.

The present petition stands disposed off on the aforesaid terms.
