JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be co-villager of the informant and admittedly, in the alleged occurrence, neither informant nor any other person sustained any firearm injury. So far as allegation of demand of extortion money is concerned, learned counsel for the petitioner points out that one month prior to institution of the present case, father of the petitioner lodged Bettiah Mufasil (Munwapul) P.S. Case No. 384 of 2015 against the informant of the present case and in retaliation to the aforesaid case, the present case has been lodged.

No doubt, petitioner carries criminal antecedent of

Patna High Court Cr.Misc. No.3544 of 2016 (2) dt.04-02-2016 2/2 some cases but taking note of the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bettiah Muffasil (Manuwapul) P.S. Case No. 497 of 2015.
