JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471,354 and 504 of the Indian Penal Code. The prosecution case is that the informant namely Gayatri Devi went to receive the benefits under Indira Awas scheme but the same was given by the petitioner being bank manager to some other Gayatri Devi when the informant inquired about the same then she was abused by calling the caste name. It is submitted by the learned counsel for the petitioner that alleged Gayatri Devi has returned the amount and the informant has retracted from the initial version and has filed a
Patna High Court Cr.Misc. No.47827 of 2014 (3) dt.22-06-2015 petition to that effect before the learned court below. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana at Motihari in connection with Phenhara P.S. Case No. 54 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
