2. In this case, the petitioner is seeking regular bail in connection with Hisua P.S. Case No. 443 of 2024, registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2018 and Section 111(3) of the Bhartiya Nyaya Sanhita (B.N.S.), 2023.
3. Recovery is of 315 litres of illicit liquor from the possession of the petitioner.
4. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely been implicated in this case. The petitioner is in custody since 30.07.2024.
5. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail
Patna High Court CR. MISC. No.64934 of 2024(2) dt.19-09-2024 2/2 bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Nawada in connection with Hisua P.S. Case No. 443 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
6. Before accepting bail bond, the criminal antecedent of the petitioner will be verified by the court below and if it is found that the petitioner is involved in any case other than the present one, the bail bond of the petitioner shall not be accepted. (Nawneet Kumar Pandey, J) Guddu/- U T
