JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 08-09-2025 Heard learned counsel for the petitioner and learned APP for the State as also learned counsel for the informant. 2.

The petitioner seeks bail in connection with Sasaram (M) P.S. Case No. 196 of 2025 instituted for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 352, 351(2), 281, 326(f) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

As per prosecution case, the accused persons including the petitioner has assaulted the informant and others. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case

Patna High Court CR. MISC. No.61686 of 2025(2) dt.08-09-2025 2/3 due to previous enmity. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. There is a case and counter case between the parties. In the alleged occurrence, both the parties have sustained injuries. He further submits that the informant and his family members assaulted Shiv Prasan Ram and he lodged Sasaram (M) P.S. Case No. 197 of 2025 for this and, as a counter blast, the informant lodged the present false case. The petitioner has no criminal antecedent and is languishing in judicial custody since 04.07.2025 without any rhymes or reason. 5.

Learned counsel for the petitioners again submits that the co-accused have been granted bail by a Co-ordinate Bench of this Court vide order dated 27.08.2025 passed in Cr. Misc. No. 58379 of 2025.

On the other hand, learned A.P.P. for the State and the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail

Patna High Court CR. MISC. No.61686 of 2025(2) dt.08-09-2025 3/3 bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sasaram (M) P.S. Case No. 196 of 2025.
