Petitioner is not named but in course of investigation he was arrested and witnesses claimed that he was seen loitering near the place of occurrence and it appears that except the aforesaid material as well as some criminal antecedent of the petitioner, there is nothing against him.

Learned counsel for the petitioner submits that petitioner is in jail custody since 08.12.2015 but up till now, he has not been put on Test Identification Parade. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
