This application for anticipatory bail, arises out of Industrial Police Station Case No. 22 of 2018, disclosing offences punishable under Section 392 of the Indian Penal Code, later on Section 395 and 412 of the Indian Penal Code has been added.
The petitioner is not named in the first information report, his name has surfaced on the basis of disclosure made by the co-accused, who was arrested by the Police. Referring to the order dated 20.07.2018 passed in Criminal Misc. No. 37311 of 2018 and order dated 30.08.2018 passed in Criminal Misc. No.
Patna High Court Cr.Misc. No.80258 of 2018(2) dt.22-01-2019 2/2 47592 of 2018, which has been submitted by similarly circumstanced co-accused persons, namely, Raju Yadav and Anand Mandal, has been granted anticipatory bail by this Court. Considering the facts and circumstances, as noted above, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IX, Bhagalpur in connection with Industrial Police Station Case No. 22 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
