JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-11-2023 The present writ petition has been filed seeking the following relief:- "1) That this writ petition has been filed in the nature of Mandamus and Certiorari to quash the notice of respondent no. 3 and further direct the respondent not to harass the petitioner by demolishing the house of petitioner without any reasonable cause. State has no urgency to acquire the land in question, the State has no any plan and scheme to acquire the land on which petitioner and others were living from many decades for more than eighty years."

At the outset, the learned counsel for the petitioner, on instruction, submits that the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 has already been passed by the Circle Officer, Khodawandpur, DistrictBegusarai, hence the petitioner be granted liberty to challenge the same by filing appropriate appeal. Liberty, so sought, is granted.
