ANJANA MISHRA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody since 06.06.2015 in connection with a case registered for the offences punishable under Sections 25(1-B)A/26 and 35 of the Arms Act. Learned counsel for the petitioners submits that though there is allegation of recovery of one country-made pistol and few cartridges from each of the petitioners, actually, this recovery has not been made from their conscious possession. It is submitted that for no fault of the petitioners, they were kept behind the bars for more than six months.

Considering the nature of allegation and also the period of custody, let the ppetitioners be released on bail on furnishing bail

Patna High Court Cr.Misc. No.3740 of 2016 (2) dt.10-02-2016 P2/2 bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 123 of 2015.
