Singh, learned counsel appearing on behalf of the Respondent No.3 and Mr. Subhash Prasad Singh, learned GA-3 appearing on behalf of the State.

Mr. Shekhar Singh, learned counsel appearing on behalf of the petitioners submits that the petitioners seek to file detail representation before the District Magistrate-cumCollector, East Champaran, Motihari for allotment of suitable shops at the place of their choice. The petitioners have already been allotted shops in Mouja- Belwanwa, which comes under the municipal area but it is situated at a remote place and is not viable to run business to sustain their livelihood.

3. Learned counsel further informs that a plot has been earmarked for construction of shops by the Municipal Corporation in Rajendra Market, appertaining to Municipal Plot No.2743.

4. Considering the aforesaid submissions made on behalf of the petitioners, the petitioners, if so advised, may file their individual representation before the District Magistrate-

Patna High Court CWJC No.13785 of 2023 dt.04-01-2024 3/3 cum-Collector, East Champaran, Motihari, who shall verify from the records, as to whether, any land has been proposed in Rajender Market for construction of shops then in that case, if event arises, petitioners may also be allowed to apply for allotment of shops in accordance with terms and conditions of such policy/decision of the State Government or Municipal Corporation.

5. With the aforesaid direction, the present writ petition stands disposed of.
